What is ADR?

Alternative Dispute Resolution (ADR) refers to methods of settling disputes without going to court. We offer a range of ADR approaches tailored to party wall and property-related conflicts, including:

  • Mediation – A neutral third party helps both sides communicate, negotiate, and reach a compromise. This process is designed to preserve relationships while achieving a fair settlement.

  • Facilitated Negotiation – Our surveyors and advisors guide discussions, helping both parties explore solutions without formal proceedings.

  • Expert Determination – A qualified professional provides an impartial opinion, often binding, on technical issues. This is especially useful where specialist knowledge is required.

  • Arbitration (rare in party wall cases) – An arbitrator hears evidence from both sides and makes a final, enforceable decision.

When ADR Works Best

ADR is often a smart choice when:

  • A Party Wall Notice has been served, but there are disagreements over access, working hours, or methods.

  • Both parties want to avoid the stress and cost of litigation.

  • You want to maintain a good relationship with your neighbour.

  • Work has not yet started, leaving time to reach a resolution without legal intervention.

In these situations, ADR can save time, money, and unnecessary conflict.

When ADR Is Not Suitable

ADR cannot replace the legal power of an injunction in every case. You may need urgent court action instead if:

  • No Party Wall Notice has been served and work has already started.

  • There is a risk of immediate or irreparable damage to your property.

  • The other party refuses to cooperate or ignores their legal obligations.

Only a court injunction can compel someone to stop unlawful works. ADR is voluntary and cannot enforce compliance.

Resolve Disputes Without Court Action

Disagreements over party wall matters can quickly become stressful and expensive if they escalate into court proceedings. At Injunct, we provide Alternative Dispute Resolution (ADR) services that help property owners resolve disputes efficiently, fairly, and with minimal disruption.

ADR is often faster, more cost-effective, and less confrontational than seeking a court injunction. It also helps preserve working relationships between neighbours - something that’s often overlooked in construction and property disputes.
